By accessing or using our website, mobile application, or services, you agree to comply with and be bound by these Terms and Conditions.

2. Definitions

• "Company," "We," "Us," or "Our" refers to ES Drive Care.
• "User" means any person using our services, including customers and drivers.
• "Driver" refers to individuals registered and verified to provide driving services through our platform.
• "Customer" refers to individuals booking or availing driver services via ES Drive Care.

3. Services

ES Drive Care provides professional on-demand and scheduled driver services, including:

• Acting drivers for personal or business use
• Spare drivers on hourly or daily basis
• Corporate and event driver solutions

We act as a facilitator between customers and drivers. The company ensures verification and coordination but is not responsible for third-party behavior outside the defined service contract.

4. User Responsibilities

By using our services, you agree to:

• Provide accurate and up-to-date information while booking or registering.
• Use our services lawfully and not for any illegal or harmful purpose.
• Treat ES Drive Care staff and drivers with respect and courtesy.
• Not attempt to damage, hack, or misuse our platform in any manner.

5. Booking and Payment Terms

• Bookings can be made via the website, app, or WhatsApp support.
• Prices are calculated based on service duration, type, and distance.
• Full payment must be completed after the service.
• Any additional charges (e.g., waiting time, night allowance) will be clearly communicated before billing.
• All payments are non-refundable once the service is initiated, except under exceptional circumstances approved by management.

6. Cancellation and Refund Policy

• Free cancellation: Up to 30 minutes before driver dispatch.
• Late cancellation: A nominal cancellation fee may apply if the driver is already on the way.
• Refunds (if applicable) will be processed within 7 working days to the original payment method.

7. Driver Conduct and Liability

• All ES Drive Care drivers are verified with valid driving licenses and ID proofs.
• Drivers are expected to follow company guidelines, maintain proper behavior, and adhere to traffic laws.
• ES Drive Care is not liable for personal belongings left in vehicles or for actions beyond service control once the driver has been assigned.

8. Customer Conduct

Customers are expected to:

• Cooperate with drivers professionally.
• Avoid requesting illegal activities or unsafe driving conditions.
• Avoid harassment, discrimination, or misconduct toward drivers.

Violation may result in account suspension or service denial.

9. Limitation of Liability

While we strive to provide the highest level of service, ES Drive Care:

• Shall not be held liable for indirect, incidental, or consequential damages.
• Is not responsible for any loss arising from delays, accidents, or third-party service interruptions.
• Provides no guarantees regarding availability, speed, or accuracy of services beyond operational control.

10. Privacy and Data Usage

All user information is handled according to our Privacy Policy, available on our website.

By using our services, you consent to the collection and use of your information as described therein.

11. Intellectual Property

All logos, trademarks, content, and materials on our website or app are the property of ES Drive Care.

Unauthorized use or reproduction is strictly prohibited.
